Dear Supporters of Clean Air in North Lake Washington: WE NEED YOUR HELP!

Please contact the committee members to support HB 1057 for our clean air. The Bill needs to pass out of committee soon! These are the suggested talking points (compiled by our lobbyist Shelly and checked by our City Manager Rob Karlinsey)

If you can get a meeting with one of the legislators, invite others to join the conversation, if you wish! Thank you in advance.

Key points to make in follow up communication with legislators:

• This bill does not change current air quality or odor standards, it only changes who can file a complaint
• This allows users of public trails, parks and common areas to file a complaint. Current law only allows those with a possessory right to file a complaint, which includes residents whether property owners or renters and businesses, owners or employees.
• Once a complaint is received, a qualified, trained inspector (clean air agency or city staff member) goes to the location where the complaint was filed in order to investigate. For odor complaints there is a specific odor evaluation form, using a scale of 0 to 4, that is completed.
• If warranted, the clean air agency would then file a notice of violation to the entity with the air quality violation and work with the entity to resolve the violation.
• This bill does not create a private right of action. Investigation and enforcement still falls within the authority of the clean air agency (and in Kenmore’s case, response to the complaint is delegated to the City of Kenmore).
• This change will allow the problem to be addressed at the local level; under current law, locals are limited in their reporting ability.
• It was stated during testimony that the Kenmore asphalt plant is in compliance with existing standards. Even if that is the case, which is debatable, the standards for this facility were established long before a community and city grew up around it. The standards should be updated to reflect the urban nature of this area but they have not been.

Who: Anyone living in Washington State who would like to speak up for environment and climate and specifically for clean air

What: Support HB 1057, an act relating to clarifying the meaning of the term “enjoyment of life and property” within the clean air act; amending RCW 3 70A.15.1030; and creating a new section (I’ll put the new section in the comments so you can read it). This bill would give community members greater agency to report odors and have them investigated.

Dear Honorable Representative,

I write, as a constituent in Kenmore, WA, in support of HB 1057. My interest in this bill is a general passion for a sustainable, healthy environment and climate and a specific concern about an environmental and public health injustice happening with emissions from an asphalt plant located at the heart of my urban/suburban community.

The bill, as I understand it, does not change current air quality or odor standards or a right of private action. It would, however, allow me, as a resident who lives outside the current legally acknowledged possessory right area but who enjoys public parks and spaces within that area, to file a complaint. Once such a complaint is registered, the protocol for responding to it would remain unchanged.

Although my interest in this bill stems from a specific issue in my local community, I imagine there are many communities across the state that would benefit from greater agency to advocate for clean, healthy air through legally recognized and enforceable mechanisms. Clean air is vital to everyone’s health.

Thank you for your hard work, care, and attention to HB 1057.

Dear Kenmore Clean Air Coalition Friends:
FYI.
We are providing more information for Cascadia (e.g.inaccurate environmental check list) and asking for an update regarding the Cascadia Law Group’s work thus far; our goal is to have clean air and public health and safety.
We are working on distributing a flyer to communicate to residents and visitors phone numbers and computer links to make complaints, whether or not you live or work from a place where you detect the obnoxious asphalt emissions, and whether or not you think they may be a benign “nuisance” or a dangerous toxic health hazard. We want help in distributing flyers and getting them on the city website in the future and at our parks/trails/city centers. We also hope to provide a health symptom survey and bring back the results of the students’ STEM air monitor testing to the city (Dr. Robin Evans-Agnew’s UW Tacoma work with PERK and Kenmore Citizens in 2017).
Please keep writing our legislators in support of Rep Gerry Pollet’s HB 1057–the deadline to get out of committee is Feb 13. WE NEED THAT TO PASS. Do you need help finding the links? Knowing what to say? If so, please call me…or reply here. We could use BIG GROUPS like BIKING, KAYAKING GROUPS bothered by asphalt emissions on the Burke Gilman Trail, or AUDUBON etc. that can write in support of the right to be heard if we detect dangerous asphalt emissions that cause us concern in public trails, parks, city centers in Kenmore and North Lake Washington (from a stationary source).

Microsoft air monitors are on the Kenmore City Council agenda tonight…AND keep in mind those air monitors did not and will not be testing for Volatile Organic Compounds. We await news on whether the City will test at Cadman’s stack for VOC’s.
